These Terms and Conditions (“Terms”) govern your access to and use of our website, content, memberships, courses, digital downloads, and any related services (collectively, the “Services”). By accessing or purchasing from The Yogic Lifestyle Therapy, you agree to be bound by these Terms.

 

1) Definitions

• “Digital Products”: downloadable or streaming content including videos, PDFs, guides, e-books, programs, templates, and other materials delivered electronically.

• “Membership”: recurring subscription offering access to Digital Products and/or features.

• “1:1 Session”: a live consultation session booked through our scheduling system, whether included within a Membership or purchased separately.

• “You / User / Customer”: the person purchasing, accessing, or using the Services.

2) Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase or use the Services.

 

3) Accounts and access

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. We may suspend or terminate access where we reasonably believe there is unauthorized use, fraud, abuse, or violation of these Terms.

 

4) What we provide

We provide educational, lifestyle, and wellbeing-oriented content, programs, and guidance. The Services may evolve over time (including updates, additions, removals, or format changes).

 

5) Health, wellbeing, and medical disclaimer

The Services are provided for educational and informational purposes only and are not medical advice. We do not diagnose, treat, cure, or prevent any disease. You are responsible for your own health decisions and for consulting a qualified healthcare professional where appropriate. Stop any activity that causes pain, dizziness, or adverse symptoms.

 

6) Purchases, pricing, and taxes

All prices are displayed in the currency shown at checkout. Taxes (including VAT) may apply depending on your location and the nature of the product. Where required, we calculate and collect applicable taxes based on the information you provide at checkout.

 

7) Digital delivery and immediate performance (EU/EEA)

Digital Products are typically delivered immediately after purchase (instant access). If you are in the EU/EEA, you may have a 14-day withdrawal right for distance contracts; however, for digital content not supplied on a tangible medium, that right can be lost once delivery/performance begins if you expressly consent and acknowledge the loss of the right. By completing a purchase for Digital Products, you request immediate access and acknowledge that your withdrawal right is lost once access/delivery begins. (EUR-Lex)

 

8) Refunds (digital products) and subscriptions

Refunds are governed by our Refund Policy, which is incorporated by reference into these Terms.

• Digital Products: all sales are final once access/delivery begins.

• Subscriptions/Memberships: you can cancel to stop future renewals; no prorated refunds for the current billing period.

Nothing in these Terms limits mandatory consumer rights that cannot be excluded under applicable law, including rights related to faulty digital content/digital services. (EUR-Lex)

 

9) 1:1 Sessions (cancellation and no-shows)

Applies to 1:1 Sessions booked within Memberships and standalone purchases:

• You may cancel or reschedule up to 3 hours before the session start time.

• Cancellations/reschedules with at least 3 hours’ notice will be handled as one of the following (at our discretion):

  • one reschedule to a mutually agreed time, or

  • session credit (where applicable).

• Cancellations made less than 3 hours before the start time, or failure to attend (“no-show”), are not refundable and the session is considered used/forfeited (including membership-included sessions).

• Session times are interpreted in the time zone shown in the booking confirmation (default: Europe/Rome).

10) License and permitted use

When you purchase or access Digital Products, you receive a limited, personal, non-exclusive, non-transferable, revocable license to use the materials for your own personal use. You may not:

• copy, reproduce, redistribute, sell, sublicense, or share the content,

• upload or post content publicly,

• provide access to third parties (including “family sharing” outside what is explicitly permitted),

• remove watermarks or proprietary notices.

11) Intellectual property

All content, branding, trademarks, course materials, videos, text, graphics, and downloads are owned by or licensed to The Yogic Lifestyle Therapy and are protected by applicable intellectual property laws.

 

12) Prohibited conduct

You agree not to:

• misuse or interfere with the Services (including hacking, scraping, or bypassing paywalls),

• engage in fraud, chargeback abuse, or unauthorized sharing,

• harass, threaten, defame, or violate the rights of others.

13) Chargebacks and payment disputes

If you initiate a chargeback or payment dispute, we may immediately suspend or revoke access to the Services while the matter is investigated. We reserve the right to refuse future purchases where disputes are used improperly.

 

14) Results disclaimer

Any examples, outcomes, or testimonials are not guarantees. Individual results vary based on many factors outside our control.

 

15) Third-party services

We may use third-party platforms (e.g., payment processors, hosting, scheduling, email). We are not responsible for third-party outages or service changes beyond our reasonable control.

 

16) Limitation of liability

To the maximum extent permitted by law, The Yogic Lifestyle Therapy will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption. Our total liability for any claim related to the Services will not exceed the amount you paid to us for the specific product/service giving rise to the claim in the 12 months preceding the event.

This clause does not limit liability where it cannot be limited under applicable law.

 

17) Indemnity

You agree to indemnify and hold harmless The Yogic Lifestyle Therapy from claims, damages, and expenses arising from your misuse of the Services or violation of these Terms.

 

18) Customer responsibility; misunderstandings

It is your responsibility to read and understand these Terms, our Refund Policy, and any checkout disclosures before purchasing. Misunderstanding, misinterpretation, or failure to read our policies does not create a right to a refund, exception, or chargeback, except where mandatory rights apply and cannot be excluded.

 

19) Suspension and termination

We may suspend or terminate access if you breach these Terms, including unauthorized sharing or chargeback abuse. Upon termination, you must stop using the content and may lose access without refund, subject to mandatory rights.

 

20) Changes to these Terms

We may update these Terms from time to time. The version in effect at the time of purchase will apply to that purchase. Continued use of the Services after changes constitutes acceptance of the updated Terms.

 

21) Governing law and jurisdiction

These Terms are governed by the laws of Italy, without regard to conflict-of-law rules. Where permitted, courts located in Rome, Italy will have jurisdiction. Nothing in this section limits consumer rights to bring claims in their country of residence where such rights apply.
